「UTokyo Channel」、本ウェブサイト及び本資料（第1条に定義）は、以下に定める条項（以下「本条項」という）の下で、国立大学法人東京大学（以下「東京大学」という）によって利用者（第1条に定義）に提供されるものであり、本条項により許諾された以外の方法で利用することは禁止されています。なお、「 UTokyo Channel」は、東京大学がこれまで運営してきた旧「UTokyo OCW （OpenCourseWare）」および旧「東大TV」を統合・承継するオンラインエデュケーションサービスであり、今後開発される同様の媒体を含みます。旧サービスにおいて提供された各種コンテンツは、本サービスにおいても引き続き配信され、今後の利用許諾の条件等については本条項が適用されます。

第1条　定義

「編集著作物」とは、素材の選択又は配列によって創作性を有する編集物をいいます。
「データベースの著作物」とは、情報の選択又は体系的な構成によって創作性を有するデータベースをいいます。
「二次的著作物」とは、著作物を翻訳、編曲、変形、脚色、映画化、その他翻案することにより創作された著作物をいいます。
「原著作者」とは、本資料の著作者（東京大学の教員であるか否かを問わない）をいいます。
「本資料」とは、「UTokyo Channel」において提供される一切の資料をいいます。

「UTokyo Channel」とは、東京大学によって「UTokyo Channel」の名称（英語名称：「UTokyo Channel」）において運営され提供される動画配信等の情報サービス（本ウェブサイト、またはYouTubeその他の外部事業者が運営するサイトのいずれにおいて配信されるかを問わず、本ウェブサイト上のリンクまたは埋め込みによる配信も含む）及びその後継サービスを意味します。
「本ウェブサイト」とは、「UTokyo Channel」を提供する東京大学のウェブサイト（「ch.u-tokyo.ac.jp」またはその後継サイト）をいいます。
「利用者」とは、「UTokyo Channel」のユーザーをいいます。

第2条　利用許諾の範囲

1. 利用者は、「UTokyo Channel」により提供される本資料を、如何なる国・地域においても、非営利かつ個人的な視聴・閲覧、もしくは非営利かつ教育的な目的においてのみ、視聴･閲覧できるものとします。利用者は、各本資料の冒頭において個別に提示される定めに従い、当該本資料を利用することができます。

2. 利用者は、著作権法その他の適用法令により認められる場合を除き、本資料またはその一部を上記以外に利用すること（以下を含むが、それらに限らない）はできません。
(1) 複製（ダウンロード、スキャンその他のデジタルコピー、プリントアウト等を含む）すること
(2) 頒布・配布・販売、または送信可能化・送信すること
(3) 本資料を利用する権利を第三者に譲渡またはライセンスすること
(4) 本資料を編集著作物やデータベースの著作物に組み込むこと
(5) 本資料の二次的著作物を作成または利用すること

3. 前項に加え、利用者は以下各号の行為をすることができません。
(1) 「UTokyo Channel」の提供に係るソフトウェアの全部又は一部を改変し、又は逆コンパイル、逆アセンブル、 リバースエンジニアリング（内容を解析して人間が読み取り可能な形に変換することを含む）すること
(2) 「UTokyo Channel」への不正アクセスを自ら行い、または第三者に行わせること
(3) 前各号のほか、法令または公序良俗に反する行為、「UTokyo Channel」の運営を妨害する行為（名誉毀損・誹謗中傷行為を含む）を行うこと
(4) 第三者（他の利用者を含む。以下本号において同じ）の権利を侵害する行為、 第三者による「UTokyo Channel」の利用を妨害する行為、第三者に迷惑をかける行為
(5) その他、東京大学が不適切であると判断する行為を行うこと

4.「UTokyo Channel」の利用に必要なインターネット等の通信環境及び受信機器等は、全て利用者が自己の責任および負担において調達するものとします。通信環境に起因して利用者による「UTokyo Channel」の利用が阻害された場合でも、東京大学は一切の責任を負いません。

第3条　権利の帰属

(1) 本ウェブサイト上のコンテンツは、東京大学または原著作者が著作権を有しています。
(2) 本資料の著作権は、原則として、東京大学および東京大学において講義を担当し、本資料を作成した原著作者に帰属します。ただし、本資料の中には、パブリックドメインとなっているものや東京大学が利用許諾を受けて掲載する第三者の著作物が含まれていることがあり、この第三者の著作物の著作権は、当該第三者に帰属します。
(3) 「UTokyo Channel」、本ウェブサイトおよび本資料の一切の利用は、本条項のほか、該当する国・地域の著作権法やその他の適用法に従ってのみ行うことができます。
(4) 東京大学は、本資料の著作権、特許権、実用新案権、意匠権、商標権、その他の知的財産権を利用者に譲渡したり、その利用を許諾したりするものではありません。
(5) 東京大学は、利用者への通知なしに、いつでも 「UTokyo Channel」 および本資料の内容を追加、削除および変更する権利を保持します。

第4条　免責規定

本資料の内容は、東京大学及び原著作者により、高い学術的水準に見合う正確性及び完成度が確保されるよう学術上の配慮がなされています。しかしながら、東京大学及び原著作者は、本資料の正確性、完成度、品質及び特定の目的への適合性について、明示・黙示の別を問わず、一切保証をするものではありません。「UTokyo Channel」、本ウェブサイト及び本資料は、現状有姿のまま提供されるものであり、東京大学及び原著作者は、明示・黙示の別を問わず何らの保証を表明するものではありません。これには、技術的な利用可能性（バグその他の不具合がないこと、並びに利用者の用いる機器及びソフトウェア等との適合性・互換性を含む）、サービス提供の適時性及び継続性、商品性、特定の目的に対する適合性、権利の非侵害性、潜在的な瑕疵やその他の欠陥がないこと、 正確性、及び発見可能・不可能の別を問わず誤りの存在や不在についての保証等をしないことを含みますが、これらに限られません。東京大学は、本資料とその他の如何なる資料との適合性についても、一切責任を負いません。さらに、東京大学は、「UTokyo Channel」、本ウェブサイト及び本資料またはそれらの利用が、東京大学やその他の第三者の特許、著作権又はその他 の知的財産権、プライバシー権、名誉権その他の権利を侵害しないことを保証するものでもありません。
東京大学並びにその評議員、理事、職員、教員、従業員その他の関係者は、東京大学への通知の有無、損害の事実の認識の有無又は損害の事実の認識可能性の有 無を問わず、いかなる場合であっても、経済的損害、物的又は人的な損害、逸失利益などを含む、付随損害、結果損害その他の如何なる損害についても、一切責任を負うものではありません。
ただし、利用者が消費者契約法上の消費者に該当する場合には、東京大学の故意または重過失に起因する損害賠償責任を除きます。

第5条 変更・中止等

(1) 「UTokyo Channel」及び本ウェブサイトは、システムのメンテナンス（定期的もしくは緊急を問わない）または障害その他の事情により、予告なく追加、変更、削除、停止または中止されることがあります。
(2) 前各号の場合において、利用者に何らかの損害が生じたときであっても、東京大学は何らの責任を負いません。

第6条　分離可能性

本条項のいずれかの規定が、適用される法の下で無効又は執行不能とされた場合であっても、本条項のその他の規定の有効性及び執行可能性には影響しないものとします。

第7条　準拠法・管轄

本条項は、日本国の法律を準拠法とし、日本国の法律に基づいて解釈されるものとします。また、本条項に関する一切の紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

第8条　通知

(1) 東京大学は、本ウェブサイト上の表示その他の適切と判断する方法により、利用者に対し随時必要な事項を通知するものとします。
(2) 前項の通知は、東京大学が当該通知の内容をサーバ上にアップロードした時点で効力を生じます。

第9条　変更

東京大学は、本条項の内容を利用者の事前の承諾を得ることなく任意に変更することができます。 この場合、本ウェブサイト上に変更内容を掲載する方法により、利用者に通知するものとします。

第10条　利用許諾の終了

(1) 本条項第２条第1項に規定する利用許諾は、利用者が利用する各本資料に含まれる著作物のすべての著作権の保護期間が満了するまでとします。
(2) 前項にかかわらず、利用者が本条項に違反した場合には、違反の時点をもって、当該利用者に対する本条項第２条第1項に規定する利用許諾を直ちに終了するものとします。ただし、当該利用者から本資料の全部若しくは一部を受領した者については、その者が本条項を守る限りにおいて、その者に対する本条項第２条第1項に規定する利用許諾は存続するものとします。

 

“UTokyo Channel,” this Website, and the Materials (as defined in Article 1) are provided to Users (as defined in Article 1) by the National University Corporation, The University of Tokyo (hereinafter “The University of Tokyo”) under the terms and conditions set forth below (hereinafter “these Terms”). Any use other than that authorized under these Terms is prohibited. Furthermore, “UTokyo Channel” is an online education service that integrates and succeeds the former “UTokyo OCW (OpenCourseWare)” and “Todai TV,” which were previously operated by The University of Tokyo. It also includes similar platforms (media) that may be developed in the future. Contents provided in the former services will continue to be distributed through this service, and these Terms shall apply to the conditions governing future use permissions.

Article 1: Definitions
“Compilation” means a work that possesses creativity by reason of the selection or arrangement of its contents.
“Database Work” means a database that possesses creativity by reason of the selection or systematic construction of information.
“Derivative Work” means a work created by translating, composing a musical arrangement of, reformulating, dramatizing, making a cinematographic adaptation of, or otherwise adapting an original work.
“Original Author” means the author of the Materials, regardless of whether they are a faculty member of The University of Tokyo.
“Materials” means all materials provided on “UTokyo Channel.”
“UTokyo Channel” means the information services (such as video streaming) and their successor services operated and provided by The University of Tokyo under the name “UTokyo Channel,” regardless of whether they are distributed on this Website or on sites operated by external operators such as YouTube, including distribution via links or embedding on this Website.
“This Website” means the website of The University of Tokyo that provides “UTokyo Channel” (“ch.he.u-tokyo.ac.jp” or its successor site).
“User” means any user of “UTokyo Channel.”

Article 2: Scope of License
1. A User may view and browse the Materials provided by “UTokyo Channel” in any country or region, solely for non-commercial personal use, or for non-commercial educational purposes. Users may use each of the Materials in accordance with the terms and conditions individually presented at the beginning of the respective Material.

2. Except as permitted under the Copyright Act or other applicable laws, Users may not use the Materials, in whole or in part, for purposes other than those specified above. This includes, but is not limited to, the following actions:
(1) Reproduction (including downloading, scanning or other digital copying, and printing out)
(2) Distribution, delivery, sale, or making transmittable or transmitting
(3) Assigning or sublicensing the right to use the Materials to a third party
(4) Incorporating the Materials into Compilations or Database Works
(5) Creating or utilizing Derivative Works of the Materials

3. In addition to the preceding paragraph, Users shall not engage in the following acts:
(1) Modifying, decompiling, disassembling, or reverse engineering (including analyzing content and converting it into a human-readable form) the whole or any part of the software associated with the provision of “UTokyo Channel.”
(2) Gaining unauthorized access to or causing a third party to gain unauthorized access to “UTokyo Channel.”
(3) In addition to the preceding items, engaging in acts that violate laws and regulations or public order and morals, or acts that interfere with the operation of “UTokyo Channel” (including acts of defamation and slander).
(4) Engaging in acts that infringe upon the rights of third parties (including other Users; the same applies hereinafter in this item), acts that obstruct the use of “UTokyo Channel” by third parties, or acts that cause nuisance to third parties.
(5) Any other acts that The University of Tokyo deems inappropriate

4. The telecommunications environment (such as an internet connection) and receiving equipment necessary to use “UTokyo Channel” shall be procured entirely at the User’s own responsibility and expense. The University of Tokyo shall not be held liable in any way even if a User’s use of “UTokyo Channel” is obstructed due to the telecommunications environment.

Article 3: Ownership of Rights
(1) The content on this Website is copyrighted by The University of Tokyo or the Original Authors.
(2) In principle, the copyright in the Materials belongs to The University of Tokyo and the Original Authors who were responsible for lectures at The University of Tokyo and created the Materials. However, some Materials may include items in the public domain or third-party works used by The University of Tokyo under license. The copyright in such third-party works belongs to the respective third party.
(3) All use of “UTokyo Channel,” this Website, and the Materials must be conducted only in accordance with these Terms, as well as the copyright laws and other applicable laws of the relevant country or region.
(4) The University of Tokyo does not transfer to the User, nor grant any license to the User for, any copyrights, patent rights, utility model rights, design rights, trademark rights, or any other intellectual property rights in relation to the Materials.
(5) The University of Tokyo reserves the right to add to, delete, or modify the contents of “UTokyo Channel” and the Materials at any time without prior notice to Users.

Article 4: Disclaimer
The University of Tokyo and the Original Authors have exercised academic care to ensure that the content of the Materials possesses accuracy and completeness commensurate with high academic standards. However, The University of Tokyo and the Original Authors make no warranties, express or implied, regarding the accuracy, completeness, quality, or fitness for a particular purpose of the Materials. “UTokyo Channel,” this Website, and the Materials are provided on an “as is” basis, and The University of Tokyo and the Original Authors disclaim all warranties, express or implied. This includes, but is not limited to, warranties regarding technical availability (including freedom from bugs or other defects, and compatibility or interoperability with equipment and software used by the User), timeliness and continuity of service provision, merchantability, fitness for a particular purpose, non-infringement of rights, absence of latent or other defects, accuracy, and the presence or absence of errors, whether discoverable or undiscoverable. The University of Tokyo assumes no responsibility whatsoever for the compatibility of the Materials with any other materials. Furthermore, The University of Tokyo does not warrant that “UTokyo Channel,” this Website, the Materials, or their use will not infringe upon patents, copyrights, other intellectual property rights, privacy rights, rights to reputation, or any other rights of The University of Tokyo or any third party.
The University of Tokyo and its councilors, directors, staff, faculty, employees, and other related parties shall in no event be liable for any incidental, consequential, or other damages, including economic damages, physical or personal injury, or loss of profits, regardless of whether The University of Tokyo was notified of, aware of, or could have been aware of the possibility of such damages. However, if the User falls under the category of a “consumer” under the Consumer Contract Act, this disclaimer shall not apply to liability for damages caused by willful misconduct or gross negligence on the part of The University of Tokyo.

Article 5: Changes, Suspension, Etc.
(1) “UTokyo Channel” and this Website may be added to, changed, deleted, suspended, or discontinued without prior notice due to system maintenance (whether scheduled or emergency), system failures, or other circumstances.
(2) Even if a User suffers any damage in the cases outlined in the preceding paragraph, The University of Tokyo shall bear no liability.

Article 6: Severability
Even if any provision of these Terms is held to be invalid or unenforceable under applicable law, the validity and enforceability of the remaining provisions shall not be affected.

Article 7: Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Article 8: Notification
(1) The University of Tokyo shall notify Users of necessary matters from time to time by posting on this Website or by any other method deemed appropriate.
(2) The notifications referred to in the preceding paragraph shall become effective at the time The University of Tokyo uploads the content of such notification to the server.

Article 9: Amendments
The University of Tokyo may amend the contents of these Terms at its discretion without obtaining the prior consent of Users. In such cases, The University of Tokyo shall notify Users by posting the amended content on this Website.

Article 10: Termination of License
(1) The license stipulated in Article 2, Paragraph 1 of these Terms shall remain in effect until the expiration of the copyright protection period for all works contained in each of the Materials used by the User.
(2) Notwithstanding the preceding paragraph, if a User violates these Terms, the license stipulated in Article 2, Paragraph 1 of these Terms shall immediately terminate for that User at the time of the violation. However, with respect to persons who have received the Materials, in whole or in part, from such User, the license stipulated in Article 2, Paragraph 1 of these Terms shall remain in effect, provided that they comply with these Terms.

「UTokyo Channel」は、「UTokyo Channel」を閲覧し、使用する人々のプライバシーを尊重すべく、本プライバシーポリシーを定めます。本プライバシーポリシーを変更した場合は、このページに反映されます。本プライバシーポリシーについて、ご意見、ご質問がありましたら、「ocw@he.u-tokyo.ac.jp」まで電子メールでお送りください。

「UTokyo Channel」利用者の皆様が、フィードバックを送る場合など、自発的に個人情報を提供しない限り、利用者の個人情報を取得することはありません。
ただし、利用者が「UTokyo Channel」の一部機能を利用するにあたり、その操作等に応じて、GoogleアカウントまたはUTokyo Accountの識別子（ID）を取得し、以下の目的その他の利用者照合のために利用します。なお、Googleアカウントに登録されているその他の情報を取得することはありません。また、Googleとの間で利用履歴等の情報連携を行うことはありません。
• マイリスト機能の提供
取得した識別子と、利用者が本ウェブサイト上で保存した「マイリスト情報（動画等の保存履歴）」を紐づけて保存し、同機能を提供するために利用します。
• 学内限定コンテンツの判定
UTokyo Accountの識別子は、学内限定コンテンツの提供にあたり、学内利用者の判別にも利用します。

利用者から自発的に提供された電子メールアドレスその他の連絡先情報については、提供者ご本人との連絡やご連絡いただいた事項への対応、「UTokyo Channel」に関するご意見の聴取、その他「UTokyo Channel」の業務改善のための内部利用の目的で、利用させていただくことがあります。もし、皆様から要求があった場合には、法令に則り、合理的かつ必要な範囲内において、連絡先情報の削除等の対応をいたします。
「UTokyo Channel」は、法令により許容される範囲内でない限り、皆様の連絡先情報あるいは他の個人情報を、第三者に開示することはありません。また、この情報を商用、あるいは、資金調達の目的に使用することはありません。

上記の場合に加えて、「UTokyo Channel」のウェブサイトを改善するため、また、「UTokyo Channel」の資料に対するアクセスや使用、および世界的な教育界への「UTokyo Channel」の影響を評価するために、以下の情報を集める場合があります。
・利用者の皆様から「UTokyo Channel」の使用や満足度に関するアンケート情報を集めることがあります(連絡先情報の提供は任意です)。
・匿名のセッション情報を「UTokyo Channel」ウェブサイトに組み込まれているウェブ解析ツールを使って分析し、「UTokyo Channel」サイトの改善のために使用することがあります。
「UTokyo Channel」へのアクセス、使用および影響に関する統計情報を公開する場合があります。これに伴い、利用者の皆様からのご意見を引用 させていただく場合があります。個人名については、ご本人の許可を得ない限り、ご意見は匿名のものとして扱います。

 

“UTokyo Channel” establishes this Privacy Policy to respect the privacy of individuals who view and use “UTokyo Channel.” Any changes to this Privacy Policy will be reflected on this page. If you have any comments or questions regarding this Privacy Policy, please send an email to [ocw@he.u-tokyo.ac.jp].

“UTokyo Channel” does not collect personal information from Users unless it is voluntarily provided, such as when submitting feedback.
However, when a User uses certain functions of “UTokyo Channel,” the identifier (ID) of their Google Account or UTokyo Account may be collected depending on the User’s actions and will be used for the following purposes and other user verification purpose. No other information registered in the Google Account will be collected. In addition, information such as usage history will not be shared with Google.
・Provision of the My List Function:
The collected identifier will be linked to and stored with the “My List Information (history of saved videos, etc.)” saved by the User on this Website to provide this function.
・Determination of On-Campus Restricted Content:
The UTokyo Account identifier is also used to identify internal users when providing content restricted to members of the university.

Email addresses and other contact information voluntarily provided by Users may be used to communicate with the User who provide the information, respond to inquiries, collect feedback regarding “UTokyo Channel,” and for other internal purposes to improve the operations of “UTokyo Channel.” Upon request from the individual, contact information will be deleted or otherwise processed within a reasonable and necessary scope in accordance with applicable laws and regulations.
“UTokyo Channel” will not disclose Users’ contact information or other personal information to third parties unless permitted by law. In addition, such information will not be used for commercial or fundraising purposes.

In addition to the above, the following information may be collected to improve the “UTokyo Channel” website, as well as to evaluate access to and use of “UTokyo Channel” materials, and the impact of “UTokyo Channel” on the global educational community:
・Survey responses regarding Users’ use of and satisfaction with “UTokyo Channel” may be collected (provision of contact information is optional).
・Anonymous session data may be analyzed using web analytics tools embedded in the “UTokyo Channel” website and used to improve the “UTokyo Channel” site.

Statistical information regarding access to, use of, and the impact of “UTokyo Channel” may be published. In this context, comments received from Users may be quoted. Personal names associated with such comments will not be disclosed without the user’s consent.
