By taking up fundamental items regarding the laws on medicine, the classwork will give thoughts to each specific problem. This is the first time a lecture on the laws on medicine is given in Faculty of Law and, by picking up various issues, the coursework is going to consider, What are these for? What does it mean for the laws to intervene in medical problems? The classwork will use teaching materials that record applicable laws and regulations, judicial precedents, concrete cases, examples in the U.K and the U.S., and will be conducted in a lecture form intermingled with a question- and- answer style. No one-sided lecture is intended. Further, if possible, there will be a dialogue session on a trial basis with a guest who has a career in business practice concerning medical service. For example, let us think afresh about the following problem: “One 61-year-old university professor A, having wobbled about and almost fallen unconscious in the class, became anxious and checked into a hospital although the symptom was temporary. There he was found to suffer from an aneurysm, and received an explanation: the rupture of an aneurysm would be a serious matter and its probability was 40% . The explanation lasting over 30 minutes included a reference to the two kinds of preventive surgery to remove an aneurysm, both of which involved a risk. He did not obtain a second opinion, nor was there any suggestion that he get one. Finally, the decision was to see how things would go with his condition, and he left the hospital. Just the following day, he died from the rupture of an aneurysm. With an intention to sue this hospital and its doctor, the bereaved family consulted you who were studying jurisprudence. How should you respond?”
